Prior Written Notice-Legal Requirements and Best Practices

We’ll review the purpose of the prior written notice, the circumstances under which provision of prior written notice is required, and the specific components that should be included in the notice. This video will review the legal requirements of a prior written notice as required by the Individuals with Disabilities Education Act (IDEA), ChildFindTX Region 4 ESC: including language and timeframe, circumstances that trigger a notice, and content components that must be addressed. This video will also share best practices for completing an appropriate prior written notice. ChildFindTX Region 4 ESC: The purpose of the prior written notice is to ensure that parents or guardians or the adult student ChildFindTX Region 4 ESC: are provided all relevant information so that they are fully informed about the actions related to special education identification, evaluation, services, and placements the LEA has proposed or refused to provide. ChildFindTX Region 4 ESC: This includes providing comprehensive documentation of the proposed or refused actions made, ChildFindTX Region 4 ESC: ensuring the parents or guardians or adult students are fully informed about any possible changes to their child's (or their own if they are an adult student) educational program. ChildFindTX Region 4 ESC: and providing sufficient information to ensure that the parents or guardians or the adult student understand the rationale behind an LEA's decision-making regarding a particular proposed or refused action. ChildFindTX Region 4 ESC: Prior written notice is specified in both Federal and State law. Let's look at the legal requirements of the notification. ChildFindTX Region 4 ESC: Let’s begin with the first requirement of a prior written notice. This requirement is found in the IDEA regulations at 34 Code of Federal Regulations (CFR) section 300.503(a) and is also included in the Texas Administrative Code at 19 TAC section 89.1050(h). ChildFindTX Region 4 ESC: The school district must provide prior written notice whenever it proposes or refuses to initiate or change the identification of a student, evaluation of a student, educational placement of a student, or provision of a free appropriate public education to the student. ChildFindTX Region 4 ESC: Notice the bolded word on this slide = written. A verbal notice does not meet the prior written notice requirement. ChildFindTX Region 4 ESC: The IDEA regulation also identifies the circumstances that trigger a prior written notice. We will look at those circumstances a bit further in just a moment. ChildFindTX Region 4 ESC: The IDEA explains what the LEA must do if the native language or other mode of communication is not a written language. ChildFindTX Region 4 ESC: The IDEA states the notice must be written in language understandable to the general public; and provided in the native language of the parent or other mode of communication used by the parent, unless it is clearly not feasible to do so. ChildFindTX Region 4 ESC: If the native language or other mode of communication of the parent is not a written language, the public agency must take steps to ensure— ChildFindTX Region 4 ESC: That the notice is translated orally or by other means to the parent in his or her native language or other mode of communication, and that the parent understands the content of the notice. ChildFindTX Region 4 ESC: Our TAC reiterates that the prior written notice must be provided in the parent’s/guardian’s or adult student’s native language or other mode of communication. ChildFindTX Region 4 ESC: What is considered “other mode of communication”? That includes communication such as American sign language, real-time computer-aided transcription services (e.g., CART), ChildFindTX Region 4 ESC: audio recordings, and/or large print materials. Please note that this is not an exhaustive list, but just a few modes of communication that should be considered when providing prior written notice to parents/guardians. ChildFindTX Region 4 ESC: The IDEA states that the notice must be provided within a reasonable time. Our TAC provides the specific timeframe of at least five school days. ChildFindTX Region 4 ESC: It is generally understood that in the computation of any legally required time period where the underlying law or regulation does not specify a method for computing time, ChildFindTX Region 4 ESC: you exclude the day of the event that triggers the period and include the last day of the period. We will look at an example of counting days in just a moment. ChildFindTX Region 4 ESC: May the parent/guardian or adult student waive the timeframe or agree to a shorter time frame of the five-school day requirement before implementation? ChildFindTX Region 4 ESC: Yes, the parent or guardian or adult student can choose to agree to a shorter timeframe or waive the required five school days, so that the actions will take place sooner. ChildFindTX Region 4 ESC: LEAs should create appropriate special education operating procedures to document that the parents/guardians or the adult student have been informed of the prior written notice requirement and timeline, ChildFindTX Region 4 ESC: but that they chose to waive such requirement and timeline so that the actions can take place sooner. ChildFindTX Region 4 ESC: When counting school days for action that was triggered (in this case a prior written notice that was provided to parents/guardians following an ARD committee meeting) on Friday, March 4, 2022, ChildFindTX Region 4 ESC: you would not count March 4th. You would begin counting the five school days on Monday, March 7th. Assuming that all weekdays during the period were school days, then Friday, March 11th would be day five. ChildFindTX Region 4 ESC: If the parents/guardians did not agree to a shorter timeframe than the five-school day requirement, then the first school day on which the student's individualized education program (IEP) could be implemented would be Monday, March 14, 2022. ChildFindTX Region 4 ESC: There are also additional timeframes for prior written notice, for example with initial evaluation requests. ChildFindTX Region 4 ESC: If a parent submits a written request to the LEA's director of special education services or to an administrative employee for an initial evaluation, ChildFindTX Region 4 ESC: the LEA must, not later than the 15th school day after the date of receipt, provide the parent with either prior written notice of its proposal to conduct an evaluation, ChildFindTX Region 4 ESC: a copy of the Notice of Procedural Safeguards and an opportunity to give written consent for the evaluation or provide prior written notice of its refusal to conduct an evaluation and a copy of the Notice of Procedural Safeguards. ChildFindTX Region 4 ESC: Parents/guardians of a child with a disability (or an adult student with a disability) may elect to receive notices (i.e., prior written notice, procedural safeguards, and due process complaint information) by an electronic mail communication, if the LEA makes that option available. ChildFindTX Region 4 ESC: Be sure to check your LEA’s special education operating procedures for more details and/or requirements for electronic communication. ChildFindTX Region 4 ESC: In this next section, we will discuss circumstances which trigger the need for prior written notice. ChildFindTX Region 4 ESC: Remember: An LEA must provide prior written notice regardless of whether the parent/guardian or adult student agrees or disagrees with the change. ChildFindTX Region 4 ESC: The school must provide prior written notice regardless of who initiated the change. Even if the parent/guardian or adult student requests the change in question, the prior written notice requirement applies. ChildFindTX Region 4 ESC: When is prior written notice required? Prior written notice must be provided to the parent/guardian or adult student when proposing or refusing to initiate or change: ChildFindTX Region 4 ESC: Identification of the student - The purpose of the prior written notice at this point is to outline for the parent/guardian the decision to refer the child for a full and individual initial evaluation ChildFindTX Region 4 ESC: and the reasons for that referral. It serves as a written notice of the LEA’s proposal or refusal to initiate or make changes that affect their child. ChildFindTX Region 4 ESC: But note a prior written notice is not required for administration of school wide screeners or implementation of general education interventions. ChildFindTX Region 4 ESC: Evaluation of the student - A prior written notice is provided at the time the decision is made to propose or refuse to evaluate; ChildFindTX Region 4 ESC: to refuse a parent’s/guardian’s request for an independent educational evaluation (or IEE); and determination of eligibility upon completion of initial evaluation or reevaluation. ChildFindTX Region 4 ESC: Educational placement of the student - The prior written notice will include the decisions for any proposals and refusals when implementing the proposed IEP and the decision to place the student in special education. ChildFindTX Region 4 ESC: Subsequently anytime a change of educational placement for that child occurs a prior written notice must be given to the parents or guardians. ChildFindTX Region 4 ESC: Whether a change in location constitutes a change in placement depends on whether it will result in a material and substantial change in the student's educational program. ChildFindTX Region 4 ESC: And when the change is in fact a change in placement, prior written notice is required. ChildFindTX Region 4 ESC: For example, if a child requires a change in placement, such as changing from a resource placement to a self-contained placement, a prior written notice must be given. If a child is graduating with a regular diploma, as this constitutes a change in placement, prior written notice must be given. ChildFindTX Region 4 ESC: But note prior written notice is not required for relocation of a special education program from one campus to another ChildFindTX Region 4 ESC: (for example, if the program for 18+ is currently at one high school, but is being moved to another high school . . . or a specialized behavior program is at one elementary campus but is being moved by the district to another elementary campus), ChildFindTX Region 4 ESC: Also prior written notice is not required for students to transfer from one school or to another district, or when the disciplinary removal is for less than 10 school days. ChildFindTX Region 4 ESC: and provision of FAPE - ChildFindTX Region 4 ESC: A prior written notice must summarize the actions proposed or rejected that relate to the provision of FAPE (or the provision of special education and related services). ChildFindTX Region 4 ESC: The prior written notice should also contain the actions and options that were proposed and considered at the ARD meeting but were determined not appropriate for the child. ChildFindTX Region 4 ESC: This includes consideration of extended school year services if that decision is made at a review/revision ARD committee meeting. ChildFindTX Region 4 ESC: Prior written notice must also be provided to the parent/guardian or adult student when: ceasing the provision of special education and related services ChildFindTX Region 4 ESC: due to the parent’s/guardian’s or adult student’s revocation of consent for services; or the student graduates with a regular high school diploma (as this terminates a student’s eligibility for special education services and constitutes a change in placement). ChildFindTX Region 4 ESC: Now let's review the required contents of a prior written notice. We'll start with an overview of the seven elements. ChildFindTX Region 4 ESC: A prior written notice has seven required components or elements: A description of the action proposed or refused by the LEA. ChildFindTX Region 4 ESC: An explanation of why the LEA proposes or refuses to take an action. ChildFindTX Region 4 ESC: A description of each evaluation procedure, assessment, record, or report used to make the decision. ChildFindTX Region 4 ESC: A statement that parents of a child with a disability have protections under the procedural safeguards of the IDEA and how parents can obtain a copy. ChildFindTX Region 4 ESC: Sources for parents to get help understanding the provisions of IDEA. ChildFindTX Region 4 ESC: A description of other options considered and the reasons why those options were rejected. ChildFindTX Region 4 ESC: A description of other factors relevant to the LEA’s proposal or refusal. ChildFindTX Region 4 ESC: The prior written notice provided after the conclusion of an ARD committee meeting can be either drafted during the ARD committee meeting as decisions are made, ChildFindTX Region 4 ESC: drafted immediately after the meeting, or soon thereafter, since it must be provided to parents five school days before implementation of actions. ChildFindTX Region 4 ESC: Although these elements appear self-explanatory, we are going to discuss some best practices for each of the required contents. ChildFindTX Region 4 ESC: But let's first start with some general best practices. ChildFindTX Region 4 ESC: First, write descriptions based on factual rather than vague or generic information. The descriptions should be based on objective information specific to the circumstance of the student. ChildFindTX Region 4 ESC: Second, provide detail that is sufficient for parents or guardians or the adult student to meaningfully participate in the decision making process. The prior written notice should fully inform the parents or guardians or adult student of the decisions and outcomes. ChildFindTX Region 4 ESC: Third, use the student’s name within the notice. This is important. This demonstrates that the notice is unique and individualized to the discussion of the student. ChildFindTX Region 4 ESC: Fourth, avoid using terms such as, “not applicable” or “none”. ChildFindTX Region 4 ESC: And finally, proofread the prior written notice document prior to issuing it to the parents or guardians or adult student. ChildFindTX Region 4 ESC: Check that you have not used acronyms that the parent or guardian or adult student is not familiar with. When using acronyms, it is best practice to spell out the acronym the first time or provide the parent or guardian or adult student with a list of common acronyms. ChildFindTX Region 4 ESC: Remember, if your LEA uses an IEP software program to prepare the prior written notice document, then do not let the prescribed allowance of characters limit the content and/or length of the document. ChildFindTX Region 4 ESC: It is also best not to use “drop-down” menus for selecting descriptions. It is best to write the descriptions including the student’s name and unique pieces to the circumstances of the proposal or refusal. ChildFindTX Region 4 ESC: Let's begin with each of the elements, starting with Element #1 – a description of the action being proposed or refused by the LEA. This element should include specific and individualized descriptions of action or actions proposed or refused for the student. ChildFindTX Region 4 ESC: This may include multiple actions for the student. It could include a proposal of an evaluation, and implementation of an IEP, and a refusal of a parent or guardian or adult student request. ChildFindTX Region 4 ESC: Each action should be described. It may be beneficial to number the actions with 1, 2, 3 or a, b, c, so that when the additional elements (specifically elements #2, #3, and #6) are written they can be aligned with action. ChildFindTX Region 4 ESC: Appropriate examples may include: Example one - The school district is proposing to conduct an initial evaluation for your child, [insert child’s name]. ChildFindTX Region 4 ESC: An evaluation plan with identified data necessary is attached. Example two - The school district is refusing your request for a full and individual initial evaluation for special education for your child, [insert child’s name]. ChildFindTX Region 4 ESC: Example three - The school district is proposing to implement (insert child’s name) IEP discussed at the ARD committee meeting on (insert date). Please see attached IEP. ChildFindTX Region 4 ESC: Keep in mind this list of examples and the other examples to follow are not exhaustive. ChildFindTX Region 4 ESC: Some non examples and statements that should NOT be included in the description of action proposed or refused by the LEA include statements like: ChildFindTX Region 4 ESC: The annual review ARD committee meeting is due or your child’s IEP needs to be updated or your child needs an IEP or your child needs to be evaluated. ChildFindTX Region 4 ESC: and probably the worst non example: see attached IEP. ChildFindTX Region 4 ESC: This is different from example number three because there's no other information provided, such as the child's name or the date of the meeting. ChildFindTX Region 4 ESC: These types of statements are vague and they do not allow the parent or guardian to be fully informed of the actions. ChildFindTX Region 4 ESC: Element #2 – an explanation of WHY the action is proposed or refused. For each action that was described in element #1, there should be an explanation of why. ChildFindTX Region 4 ESC: Again, the description should be specific not vague and should fully fully inform the parents or guardians of why the action described in element #1 was proposed or refused. ChildFindTX Region 4 ESC: This element is significantly important if the LEA is refusing a request from a parent/guardian. The parents/guardians should clearly understand HOW and WHY the LEA reached its decision on a specific action. ChildFindTX Region 4 ESC: Appropriately appropriate examples may include: Example one - Your child, [insert child’s name], has not made sufficient progress in reading intervention and has not met expectation on the universal screeners or district benchmarks for reading. ChildFindTX Region 4 ESC: Example two - At this time, your child, [insert child’s name], is making progress in the general education curriculum based on universal screeners, district benchmarks, and state assessment. He is also not demonstrating any emotional/behavioral/social concerns or any difficulties in the classroom. ChildFindTX Region 4 ESC: Example three - The IEP for [insert child’s name] must be reviewed, updated, and implemented at least annually in order to determine progress and anticipate growth for the next annual year. ChildFindTX Region 4 ESC: Some non examples and statements that should NOT be included in the description of why the action was proposed or refused by the LEA ChildFindTX Region 4 ESC: include statements like: your child needs an evaluation, or a three year reevaluation is due, or your child needs speech therapy, or your child qualifies for special education. ChildFindTX Region 4 ESC: These statements again are vague and do not provide a reason why the action was proposed or refused. ChildFindTX Region 4 ESC: Before reaching its decision to refuse a parent or guardian request, the committee should explain how it considered parent or guardian written and or verbal input, ChildFindTX Region 4 ESC: and any concerns they expressed. This may include collaboration or clarifications from the parent or guardian to ensure the information and decisions are properly and appropriately documented. ChildFindTX Region 4 ESC: Element #3 - a description of each evaluation procedure, assessment, record, or report the LEA used as a basis for the proposed or refused action. ChildFindTX Region 4 ESC: This is not just a list of evaluation procedures assessments records or reports, but also how those sources of data were used as a basis for proposing or refusing an action. In other words, how did this data or information impact the decision. ChildFindTX Region 4 ESC: Appropriate examples include: Example one - Teacher and family reports, work samples, a review of special help given to [insert child’s name] ChildFindTX Region 4 ESC: in his current classroom and school records were used to determine to evaluate him for special education. ChildFindTX Region 4 ESC: Example two - [Insert child’s name]’s appropriate and adequate progress was based on teacher input, observations, results of teacher-made and unit tests, universal screeners and district benchmarks, as well as attendance and discipline records. ChildFindTX Region 4 ESC: Example three - [insert child’s name]’s continued eligibility for special education was determined by reviewing her current full and individual evaluation and evaluating her performance on goals with current services and supports, as well as teacher and family input. ChildFindTX Region 4 ESC: Some non examples and statements that should NOT be included in the description include statements like: the assessment team reviewed the special education referral, or prior interventions weren't successful in improving the child's behavior, or an ARD committee meeting was held. ChildFindTX Region 4 ESC: Be sure to document any oral or written information provided by the parents or guardians from a private provider. ChildFindTX Region 4 ESC: Including identifying the provider by name and ensuring that the written documentation can also be easily identified, such as the type of information being provided. ChildFindTX Region 4 ESC: For example, was it a psychological evaluation or an observation or recommendation? And also include the date the document was prepared and or provided, or the date that it was signed by the provider. ChildFindTX Region 4 ESC: Element #4 – A statement that parent(s) of a child with disability have protection under the procedural safeguards and how a copy may be obtained. ChildFindTX Region 4 ESC: The prior written notice should identify from whom and where the parents/guardians may obtain their copy. Remember – the notice of procedural safeguards provided to the parent/guardian must include LEA-specific contact information on the back cover. ChildFindTX Region 4 ESC: If providing a prior written notice to propose or refuse a full and individual initial evaluation, then a copy of the notice of procedural safeguards must accompany the notice. ChildFindTX Region 4 ESC: The Notice of Procedural Safeguards can be found on the Legal Framework for the Child-Centered Special Education Process website. ChildFindTX Region 4 ESC: Additionally, other language translations of the document can be found on the SPEDTex website. We have included links to both resources at the end of this presentation. ChildFindTX Region 4 ESC: Element #5 - A description of any other options the ARD committee considered and reason for the rejection of those options. ChildFindTX Region 4 ESC: This element should include a statement of other considerations. If there were no other considerations, then a complete statement should be written to make it clear to the parents or guardians. ChildFindTX Region 4 ESC: Examples of appropriate descriptions include: Example one - The ARD committee considered continued general education interventions instead of proposing an evaluation, but determined an evaluation was necessary given insufficient progress in the current reading intervention. ChildFindTX Region 4 ESC: Example two - There were no other factors, outside of those listed above, that were considered by the ARD committee. Neither [insert child’s name], the parents, nor any LEA personnel participating in the meeting, presented any other factors that needed to be considered. ChildFindTX Region 4 ESC: Example three - The ARD committee considered placement for [insert child’s name] in a more restrictive setting but decided against that option because she is making sufficient progress in the current setting as indicated by progress reports and teacher input. ChildFindTX Region 4 ESC: Non examples and statements that should NOT be included in the description are items like: no other options need to be considered, or none, or the student is being served in regular education (i.e., the least restrictive environment) so no other options need to be considered. ChildFindTX Region 4 ESC: Element #6 - A description of any other factors that are relevant to the LEA’s proposal or refusal. This element may include language/cultural issues, communication concerns, behavior concerns, harmful effects of the program/placement, and assistive technology. ChildFindTX Region 4 ESC: Appropriate examples may include: Example one - [Insert child’s name] has a health condition that requires frequent restroom breaks. This accommodation is addressed in the attached IEP. ChildFindTX Region 4 ESC: Example two - ChildFindTX Region 4 ESC: The ARD committee reviewed any potential language/cultural issues, behavior concerns, and harmful effects of the placement, ChildFindTX Region 4 ESC: and determined no other factors are relevant to the LEA’s proposal of [insert what is being proposed]. ChildFindTX Region 4 ESC: Example three - Consideration should be given for further evaluation for other health impairment for [insert child’s name]'s. She has a diagnosis of ADHD and needs testing sessions broken into smaller segments to obtain optimal results. ChildFindTX Region 4 ESC: It is not recommended that “none” or “not applicable” be written, nor should this section be left blank. ChildFindTX Region 4 ESC: If there are no other factors relevant, then write a complete statement clearly identifying that the ARD committee reviewed all other potential factors, and determined none that would affect the LEA’s proposal or refusal. ChildFindTX Region 4 ESC: Lastly, element #7 - Sources for the parent to contact in order to obtain assistance in understanding the provisions of the notice requirements. ChildFindTX Region 4 ESC: This section should identify sources for the parents/guardians to contact should they need assistance. Sources should include the contact information for the LEA, ChildFindTX Region 4 ESC: the Regional Education Service Center, and a Parent assistance organization – for example, Partners Resources Network or SPEDTex. ChildFindTX Region 4 ESC: Now that we have covered the seven required components of a prior written notice, let’s take a closer look at two situations that require additional information to be included with the prior written notice = Proposal to Evaluate and Proposal to Convene an ARD Committee Meeting ChildFindTX Region 4 ESC: When proposing to evaluate (whether it is an initial evaluation or reevaluation) ChildFindTX Region 4 ESC: You want to ensure that the parent or guardian or adult student clearly and completely understands why the evaluation is being recommended, ChildFindTX Region 4 ESC: including the multiple sources of data that led to the decision. Based on this data, at the time of consent for evaluation is obtained, ChildFindTX Region 4 ESC: You should make the parent or guardian or adult student aware of the possible educational disability condition or conditions ChildFindTX Region 4 ESC: that could result in their child meeting the criteria for special education and related services. This should not come as a surprise to the parent or guardian or adult student at the time they receive evaluation results. ChildFindTX Region 4 ESC: When an LEA proposes to evaluate a student, there is additional information that should be included with the required seven components of the prior written notice. ChildFindTX Region 4 ESC: The parents/guardians should also be notified of the type or types of assessment or assessments that will be conducted. ChildFindTX Region 4 ESC: This does not mean specific names of test instruments, but the parent or guardian should be informed of the types and areas of assessment that will be conducted with their child. The parents or guardians should also be notified of the method or methods of assessment. ChildFindTX Region 4 ESC: And the parents or guardians, should we also be notified of the persons who will conduct the assessments - this does not mean specific names of personnel, but should identify the multidisciplinary evaluation team members by role who will be involved in conducting the evaluation. ChildFindTX Region 4 ESC: The invitation to the parents or guardians or adult student to participate as a member of the ARD committee must satisfy the content requirements of prior written notice. The prior written notice provided in advance of an ARD committee meeting is a proposal to convene the meeting. ChildFindTX Region 4 ESC: In addition to the seven required components, the notice should inform the parents or guardians or adult student ChildFindTX Region 4 ESC: of the meeting early enough to ensure that they have had an opportunity to attend. In Texas, that means that the meeting notice must be provided at least five school days before the meeting, or fewer if the parents or guardians or adult students agree to a shorter timeframe. ChildFindTX Region 4 ESC: The notice should as well indicate the purpose time and location of the meeting, and who will be in attendance, ChildFindTX Region 4 ESC: including informing the parents or guardians or adult student of the participation of other individuals who have knowledge or special expertise about the child, ChildFindTX Region 4 ESC: and/or participation of a Part C service coordinator or other representatives of the Part C system at the initial meeting is for a child previously served under Part C or Early Childhood Intervention (ECI). ChildFindTX Region 4 ESC: For all other meetings convened for reasons that are not applicable to prior written notice requirements, the invitation does not need to include all elements of the prior written notice. ChildFindTX Region 4 ESC: As we close out our review of prior written notice, here are some additional resources which you may find helpful.
